By booking a service with Phoenix (Pheeyue Creative), you agree to the following terms and conditions. These are here to create clarity, protect our creative exchange, and ensure mutual respect throughout our collaboration.
1. Services Offered
These terms apply to the following offerings:
Creative Photoshoot
Creative Photo + Video Shoot
Embodied Essence Experience
Each service is delivered as outlined on the Services page. Any additions or customizations must be confirmed in writing prior to the shoot.
2. Payments + Deposits
A non-refundable deposit is required to reserve your session.
The remaining balance is due no later than the day of the shoot, unless otherwise arranged.
Bookings are not confirmed until the deposit is received.
3. Rescheduling & Cancellations
You may reschedule your session with at least 72 hours' notice.
Cancellations made with less than 72 hours' notice will forfeit the deposit.
One complimentary reschedule is allowed; additional changes may require a fee.
4. Delivery of Work
Final edited photos/videos will be delivered within 3-14 days, depending on the service.
All galleries are delivered via a private online link.
Edits include color grading and light retouching — additional retouching may incur an extra fee.
5. Creative Rights & Usage
All images and video content created by Phoenix remain the intellectual property and copyright of Phoenix.
Standard License (Included)
Clients are granted a non-exclusive, non-transferable license to use the delivered content for:
Organic social media
Website use
Press features
Email marketing
Personal and brand promotion
This license is perpetual for organic use.
Paid Advertising
Paid advertising usage (including boosted posts and digital ads) is permitted for businesses with ad spend under $5,000 per campaign.
For campaigns exceeding this amount, extended advertising rights must be negotiated and licensed separately.
Term & Renegotiation
While organic usage is perpetual, Phoenix reserves the right to renegotiate licensing terms if the scope of usage significantly expands beyond the originally agreed intent (e.g., national campaigns, product packaging, large-scale distribution, or substantial brand growth directly leveraging the work).
This ensures fair compensation aligned with business growth and exposure.
AI & Prohibited Uses
Images and videos created by Phoenix may not be:
Used for AI training, machine learning datasets, or generative platforms
Minted as NFTs
Resold, sublicensed, or transferred to third parties
Altered beyond the original creative intent without written permission
Portfolio & Promotional Rights
Phoenix retains the right to use all commissioned work for portfolio, website, social media, editorial submissions, and promotional purposes.
If a client requires exclusivity or removal of portfolio rights, this may be arranged for an additional licensing fee of 50–100% of the original project rate, depending on scope and duration.
Full copyright transfers or buyouts are available upon request and are quoted separately.
6. Liability
Phoenix is not liable for any injuries, property damage, or unforeseen incidents that occur during the shoot.
If for any reason Phoenix is unable to perform the session (e.g., illness, emergency), you will be given the option to reschedule or receive a full refund.
7. Embodied Essence & Holistic Offerings
These experiences are offered with intention, mindfulness, and spiritual care. While healing and empowerment may arise, they are not a substitute for professional mental or medical support. You agree to participate at your own pace and discretion.
8. Communication
All correspondence will be through email or agreed-upon channels.
Clients are expected to respond to planning questions in a timely manner to keep the process flowing.
You’ll receive a prep guide and any important info once your booking is confirmed.
9. Respect + Energy Exchange
This is a co-creative process. Phoenix reserves the right to decline or cancel services if the working relationship becomes disrespectful or misaligned, with a refund of any unused portion.
